MSP World goes virtual: 5 hot topics at the mega event for Medicare Secondary Payer

The industry’s most comprehensive conference for Medicare Secondary Payers (MSP) will be livestreamed May 29-30.

This year’s virtual event, which brings together leaders in insurance, health care, financial services, and litigation to discuss critical topics impacting MSP, will feature 12 sessions, more than 20 speakers, and nine hours of virtual programming. Here’s a look at five sessions you won’t want to miss.

DEFINING UNTIMELY REPORTING UNDER THE FINAL RULE ISSUED BY CMS

Conference chair and MSP expert Rafael Gonzalez, Esq., partner, Cattie & Gonzalez, PLLC, will moderate this panel discussion. The session will focus on reporting time frames, financial penalty for reporting outside of the required time frames, and best practices to ensure timely and compliant reporting.

Panelists include Susan Montoya, assistant vice president, Travelers; Suzanne Jordan, SCHIP compliance manager, Broadspire; and Shelley Wisniewski, Medicare lead consultant, Allstate.

PREPARATION AND BEST PRACTICE TECHNIQUES FOR RANDOM SAMPLE AUDIT 

Gonzalez returns to moderate another panel that will explain the process of CMS random selection of 1,000 cases per year to audit. Panelists will offer information to help you prepare your team for quarterly audits of 250 files to ensure compliance and successful timely reporting and identify strategies to confirm that all cases meet the new CMS regulations to avoid hefty penalties. The panel will include Jordan, Wisinewski, and Susan Lin, assistant vice president, Travelers.

ASSESS CMS NEW TIERED APPROACH TO CIVIL MONETARY PENALTIES 

This session will focus on the new penalties based on tardiness of submission. Attendees will learn how to evaluate the potential penalties in their case load due to reporting. Panelists will also discuss best practices to manage your cases to ensure timely submissions. The panel includes Montoya, Jordan,and Wisniewski. Gonzalez will serve as moderator.

IDENTITY “SAFE HARBOR” COMPONENTS WHICH MAY DO AWAY WITH CMPS

Our rockstar panel returns for this session that explores technical or system issues that could potentially forgive CMPs. Panelists will discuss possible CMS or contractor errors, which could result in an exemption of CMPs. They’ll also examine facts regarding lack of cooperation by the beneficiary that may have hindered timely submission which could excuse CMPs.

AN ANALYSIS OF WORKERS COMPENSATION AND LIABILITY LEGALLY BASED MSA ALLOCATIONS 

John Cattie, Esq., managing partner, Cattie & Gonzalez, PLLC, will take part in this session that reviews the differences between medically based and legally based MSA allocations. The session will include a discussion of the components of a legally based MSA allocation and an analysis of how MSA legal opinions protect Medicare and litigants, without CMS approval.
